Falling behind on tax returns is more common than people realise. Whether it’s due to life changes, illness, business pressures, or simply losing track, many taxpayers find themselves with several years of unfiled returns. The good news is that there is a clear process for getting back on track and Revenue will generally work with you once you take the first step.

Understanding your obligations

If you are self-employed, a landlord, a company director, or have other taxable income you are required to file a Form 11 each year. If you are a PAYE worker with no additional income, you may not need full returns for every year or sometimes only specific years must be filed. A accountant can quickly check your Revenue profile and confirm exactly which returns are outstanding.

Step 1: Establish what years are missing

The first step is to identify the years where returns have not been filed. This can be done through reviewing your Revenue Online Service (ROS) profile, checking notices issued by Revenue and confirming periods where you had taxable income. This creates a clear roadmap for bringing your tax affairs up to date. Revenue focuses on years where you were required to file, years where taxable income existed and years where tax may be due. If you had no income or were below thresholds, those years may not require full returns.

Step 2: Gather the necessary information

For older years, Revenue does not expect perfect records. They expect reasonable, supportable figures. Depending on your circumstances, you may need:
  • Income details (self‑employment, rental, dividends, share disposals)
  • Bank statements
  • Expense records
  • Medical receipts
  • Pension contribution statements
  • Details of credits or reliefs you may be entitled to

Where records are missing, information can often be reconstructed from bank statements or employer summaries.

Step 3: File the most recent years first

Revenue typically prefers a latest first approach. This means filing the most recent one to four years and then working backwards through older years. This demonstrates cooperation and helps stabilise your current tax position quickly.

Step 4: Expect interest and possibly penalties

When returns are late, Revenue may apply interest on overdue tax, surcharges for late filing (typically 10%) and penalties in more serious cases. However, penalties may be reduced when you voluntarily come forward and engage proactively. If tax is owed, Revenue can agree a payment plan based on your circumstances.

Step 5: Consider a Voluntary Disclosure for long gaps

Where several years are outstanding (particularly five to ten years or more) a Qualifying Voluntary Disclosure may be appropriate. This is where you give all the details regarding tax or duty defaults, sign a statement declaring that all details provided are correct to the best of your knowledge, and then pay what is owed. This can reduce penalties, avoid publication on the tax defaulters list and avoid criminal prosecution. A Qualifying Voluntary Disclosure allows you to settle matters cleanly and efficiently. An accountant can guide you through this process and prepare the necessary documentation.

Step 6: Professional support makes the process easier

Worrying about outstanding tax returns and possible contact from Revenue can cause considerable stress. Having the right support in this situation can be invaluable. If you are unsure where to begin, we strongly encourage you to reach out to us.

Our accountants can communicate with Revenue on your behalf, so you don’t need to deal with them directly yourself. They can help prepare and advise on voluntary disclosures. They can reconstruct missing records and prepare any outstanding returns. They can also help negotiate payment arrangements and make sure you are not paying more than you need to.

It Is always better to come forward voluntarily. No matter how many years are outstanding, the situation is fixable. Once you take the first step, the process becomes structured and manageable. Revenue responds far more positively when you engage early and voluntarily.
